Redding Regional Chapter of Safari Club International Terms and Conditions 2021
Redding Regional Chapter of SCI (herein after called “RRC-SCI”) is a Section 501(c)(4), non-profit membership organization whose mission is conservation of wildlife, education of the public, and advocacy for hunting and hunter's rights. RRC-SCI appreciates the support of its donors and members in helping to further its programs and goals. Auction revenue funds a great portion of RRC-SCI's operating budget. Since RRC-SCI is a chapter of SAFARI CLUB INTERNATIONAL (SCI), all reference to RRC-SCI herein includes SCI.
Terms:
• The term “auction” refers to the online auction of donated hunts and trips (herein after called “hunts”).
• The term “Winning Bidder” will be the highest bid at close of auction. The auction for RRC-SCI is an online version of a Silent Auction normally held at Fundraising Banquets where at a certain time during the fundraising activities bidding will close and the highest bid on the auction sheet for each item is the winning bidder.
• The term “bidder’s premium” is a 5% charge that will be added to the highest bid for the online sales cost to RRC-SCI.
AUCTION BIDDING PROCEDURES AND CONDITIONS OF SALE
1. A PROSPECTIVE BIDDER MUST REGISTER IN ORDER TO PLACE BIDS IN THE ONLINE AUCTION. Each bidder must register to become a valid bidder and provide a credit card number before bidding on any hunt. A person registered and bidding through the onlinehuntingauctions.com online auction site will be considered to be registered and qualified to bid. A person who bids on behalf of another person or group will be ultimately held responsible for payment in its entirety. Only one credit card number will be allowed to bid on any hunt and will ultimately be charged for the sale if they are the Winning Bidder.
2. ALL HUNTS AUCTIONED ARE SOLD “AS IS”. RRC-SCI assumes no responsibility for the validity of the descriptions, authenticity, or conditions encountered of any hunt donated for auction. RRC-SCI makes no warranty or guarantee, express or implied, regarding any hunt, outfitting service or safari sold at auction including, but not limited to, any warranty of fitness of purpose or merchantability. Values listed are as stated by donors and are not warranted by RRC-SCI for any purpose.
3. ERRORS AND OMMISSIONS MAY HAVE OCCURRED. All hunts have been acquired or obtained by RRC-SCI from third parties. The information with which to make the auction description may have been by US Mail, email, advertisements and donor’s website(s). RRC-SCI makes no guarantee of accuracy of the description of a hunt or the completeness of the donor’s description of the hunt. The purchaser acknowledges that the donations have not been inspected by RRC-SCI and that the purchaser is advised to perform their own due diligence. No services auctioned are to be, or will be, performed by RRC-SCI. Although RRC-SCI has made every effort to ensure the accuracy of donated hunts, it cannot and does not, guarantee the satisfaction of either the donor or the purchaser.
4. ACCURACY AND COMPLETENESS OF EXPENCES. Although RRC-SCI has make reasonable efforts to list all extra and ancillary expenses not included in hunt, the list of expenses, especially air or ground transportations costs and lodging before and after the hunt, in auction item descriptions should not be considered exhaustive or definitive and RRC-SCI will not be held responsible for their completeness or accuracy. The amounts of additional expenses listed in auction item descriptions are approximations and are subject to change without notice. Bidders should contact relevant donors before bidding for additional and updated information about expenses one can expect to incur in taking a hunt or trip or in using a service provided by the donor(s).
5. ALL SALES ARE FINAL-NO REFUND POLICY. This purchase is non-refundable. In no event shall purchaser seek reimbursement from RRC-SCI and purchaser acknowledges and agrees that SCI is not liable to refund the purchase price or any portion thereof. Unless otherwise indicated, all auction hunts must be used within one year of the date of the purchase at auction, unless specifically stated. Most donors are flexible regarding extending a hunt to the next year, although there may be a charge for that service.
6. IT IS THE PURCHASER’S RESPONSIBILITY TO CONTACT THE DONOR REGARDING PURCHASED HUNTS and to make all arrangements for hunt dates and the application for necessary paperwork for licenses and permits. The purchaser should contact the donor within 30 days after the purchase, otherwise, the hunt might be considered forfeited by the donor. RRC-SCI will not act as a conduit or go-between the purchaser and the donor. The donor’s contact information is listed in the Description of each hunt in the auction line-up. In addition, information will be sent to the purchaser within fifteen (15) working days after the funds have been received that will include the donor’s contact information.
7. RELEASE OF LIABILITY. By making a purchase, the purchaser waives any claim for liability against RRC-SCI or the donor of any property or service, and neither RRC-SCI nor the donor is responsible for any personal injuries or damages to property that may result from the utilization of any services sold. If any action or claim is made against RRC-SCI by an individual, entity, or state, local, federal, foreign or political body for any matter whatsoever arising from the use of the auctioned items, or any actions or parties conducting business with respect to the auctioned items, the donor and/or purchaser will pay RRC-SCI’s attorneys’ fees and costs and will hold RRC-SCI harmless from any judgment thereon.
8. TAX IMPLICATIONS-BOTH DOMESTIC AND ABROAD. Items donated to RRC-SCI and amounts paid to RRC-SCI as part of the auction do not qualify as charitable US deductions. RRC-SCI is not a qualified charitable organization. Refer to IRS Publication 1391, Deductibility of Payments Made to Charities Conducting Fund Raising Events and consult your tax advisor for information about charitable deductions. Also some hunts are subject to VAT and GST tax liabilities based on the donor’s valuation. Often these taxes are due and payable before a hunt can be taken. Other items may be subject to sales taxes in certain countries. RRC- SCI does not assume responsibility for these fees. Interested bidders and buyers should verify amounts with donor and check with the local government where a hunt is to be taken to validate tax rates.
9. GOVERNING BODY. The auction and purchases made at the auction shall be governed in all respects, whether as to validity, construction, capacity, performance, or otherwise, by the laws of the State of California, except as preempted by federal law and that venue for any and all actions, including litigation, mediation and/or arbitration, shall be in Shasta County, California.
10. UNSUCCESSFUL HUNTS/ABSENCE OF TROPHY ANIMALS. RRC-SCI does not guarantee or warrant that a trophy animal or any animal will be taken during the period of the hunt. Location or taking an animal of any trophy quality or otherwise is not a condition of acceptance by the purchaser for purchasing the hunt. Further, animals wounded and/or lost are usually considered animals “taken” by the donor and the purchaser’s hunt is concluded. Hunting is a matter of luck, hunter’s skill, time and weather conditions, therefore RRC-SCI will not be responsible for any condition of the hunt.
11. FORCE MAJEURE. RRC-SCI will not be responsible for, or liable for, any political unrest, epidemic or extreme weather condition that may occur inside or outside the United States, nor can RRC-SCI be accountable for any injuries or damages that may arise there from.
