2. Item Descriptions: All items are sold "as is, where is." We make no guarantees or warranties regarding the items sold. The descriptions provided in the catalog are for reference and are based on our opinion. We acknowledge that errors may occur in these descriptions. We strongly recommend inspecting items personally or seeking the opinion of a qualified expert. No refunds or returns will be accepted.
3. Firearms Disclaimer: Regarding firearms, we make no warranties or representations concerning their operation, condition, safety, or reliability. The use of any purchased firearm or ammunition is entirely at the user's risk. We recommend having all firearms inspected by a competent gunsmith. We disclaim any liability for accidents, injuries, or damages resulting from the storage or use of firearms or ammunition.
4. Online Bidding Premium: For online and absentee bidders, we will email you a preliminary invoice at the conclusion of the second day of the sale. We may use the last FFL you provided, but if there are changes, please notify us by email. An 18% buyer's premium applies to HiBid, Proxibid, iCollector, and Live Auctioneers, Bidding direct with us is 15%. There is a 3% discount for checks, money orders, and ACH transfers, Wire Transfers are a $30 flat fee. It is your responsibility to contact the valid FFL provider of your choice for the transfer.
5. Compliance with Laws: It is your responsibility to understand and comply with local, state, and federal laws regarding the items you bid on. No refunds or returns will be issued for items that are not allowed in your jurisdiction. All sales are final.
6. Inspection and Responsibility: Bidders who are not present at the live auction understand that they may not have the opportunity to inspect items in person. It is your responsibility to determine the condition, age, authenticity, and value of items before bidding.
7. Internet Bidding: We offer internet bidding as a service, but we do not guarantee its functionality. We are not responsible for missed bids due to technical issues. 8. Auction House's Right: We reserve the right to withdraw or re-catalog items in the auction.
9. Payment: All sales are for cash, cashier's check, local personal check with pre-approval, Visa, MasterCard, Discover Card, or Debit Card. A Credit Card processing fee of 3% will be added to all credit card payments. There will be a $50.00 fee for returned checks or chargebacks.
10. Pickup and Storage: Locals, Items must be paid for and picked up within one week of the sale unless prior arrangements have been made. A late charge and storage fee of $5.00 per day will apply after 14 days. After 60 days, items will be considered abandoned.
11. Shipping: We use FedEx and U.S.P.S. for shipping. Shipping charges include a box fee and required insurance. Small, crated items will be quoted before shipping. We provide in-house shiping and work diligently to keep costs to a minimum.
12. Firearms and Legal Requirements: All firearms must comply with local, federal, and state laws. Out-of-state buyers must have their dealer supply their Federal Firearms License (FFL) before shipping. It is your responsibility to know and comply with your state and local firearm requirements. Have your dealer email their FFL to transfers@brandusedworks.com and make sure they include your name on the email.
13. Liability and Safety: By participating in this auction, you release the seller and Brand Used Works Auction House LLC. and its affiliates from any liability related to the purchase, ownership, possession, use, or misuse of items. All firearms should be inspected by a certified gunsmith before use.
14. Miscellaneous:
*Colorado Sales Tax is payable by buyers liable for tax.
*All bids are per the catalog number, and all items will be sold in numerical order.
*We reserve the right to refuse any bid not believed to be in good faith.
